Clarifying Question 6’s Impact on Parental Notification for Minor Abortions

Question 6 does not address the topic of minors or the requirement for parental notification regarding abortions. The constitutional amendment proposed is aimed at establishing a fundamental right to abortion until the point of fetal viability. It permits state restrictions solely for the health protection of the person seeking the procedure, and only by the least restrictive means.
Nevada’s 1985 statute mandating parental notification or judicial approval for minors seeking abortions was initially blocked in federal court. It was subsequently allowed to take effect in 2025, but in May 2026, the Nevada Supreme Court ruled to block it again, citing it as likely unconstitutionally vague. Assemblyman David Orentlicher from Las Vegas indicated that Question 6 would not affect the new law enabling minors to seek judicial approval instead of notifying parents. Voters approved Question 6 in 2024, but it requires a second approval on November 3 to become law.
